For over a decade, employers have established policies and procedures for responding to employee social media posts that are potentially harmful or negative to the brand. The COVID-19 global pandemic and heightened emphasis on social justice in the wake of several high-profile killings by the police, have added new layers of complication for employers to navigate, as they try to balance empathy for their workforce, with policy and legal compliance. This presentation will explore the potential legal and practical pitfalls employers should consider when responding to employee social media posts in the era of COVID-19 and Black Lives Matter.
