McLaren Macomb: Implications for Employers and Employees

The National Labor Relations Board’s recent decision in McLaren Macomb, 372 NLRB No. 58, altered the landscape concerning confidentiality and non-disparagement provisions in severance agreements. The general counsel’s memorandum interpreting it, Memorandum GC 23-05, suggests that the decision may have far-reaching consequences and impact other provisions in severance and other agreements, including non-solicitation clauses and releases of liability. Please join us for a discussion of what the decision means for employers and employees, both in unionized and non-unionized workforces, and the status of confidentiality and non-disparagement provisions in employee handbooks, severance agreements, separation agreements, and other workplace documents in light of the decision and other legal developments at the federal and state level.
