As technology rapidly evolves, so does the manner in which employers and employees store information.  Labor practitioners are not exempt.  When a union makes an information request for emails from an employer, they may be asked in response to provide search terms for the employer to use to locate emails.  Then, instead of a printout, the union may receive a large digital file with thousands of pages of documents that must be downloaded using unfamiliar software.  Likewise, an employer may seek to obtain a grievant’s telephone or laptop computer for an intensive forensic analysis, searching for emails, text messages and other digital information.  All of this is possible in the brave new world and labor practitioners must be ready for it.

We will have a dinner seminar with two experts on ESI – John Lucich, the owner of eForensix, and Ben Kusmin, Esq., litigation attorney from the law firm of Windels Marx Lane & Mittendorf.  These ESI pros will tailor their presentation to explain what labor practitioners need to know about ESI – whether it is in pursuing an information request, defending a grievance or obtaining discovery for an arbitration or lawsuit.  We hope that you will come to Il Castello’s to enjoy a delicious dinner and learn about this important development that affects all of us.
