“Bargaining in Distressed School Districts”

Act 141 of 2012, also called the School District Financial Recovery Act, amended the Pennsylvania Public School Code to provide a system to identify and support public school districts in various stages of financial distress. A school district’s identification under this law, as well as the realities of financial distress itself, can add complexity to an already-difficult bargaining situation and impact bargaining concerns such as salaries, salary step placement and movement, vacancies, healthcare
benefits, charter enrollment, and employee recruitment and retention. The speaker will discuss the law and draw on his experience with both the Reading School District and the Harrisburg School District to showcase some of the difficulties and opportunities involved in bargaining on behalf of a financially distressed school district.

Speaker

Jeffrey T. Sultanik, a partner with Fox Rothschild LLP, concentrates his practice in personnel and labor relations for municipal and school entities and chairs the firm’s Education Law Group. Jeff has authored more than 130 articles on education and labor law, is a frequent media source for these issues, and is a past president of the Pennsylvania School Board Solicitors Association, a division of the Pennsylvania School Boards Association.
